BILL NUMBER: S5795 TITLE OF BILL : An act to amend the education law and the state finance law, in relation to increasing the transparency of the local impact of state policy-making PURPOSE OR GENERAL IDEA OF BILL : Amends the education law to require greater transparency and input from school districts with regard to SED regulations, and amends the state finance law require the Comptroller to prepare an annual report compiling information from fiscal notes that accompanied any bill containing a local mandate and regulatory impact statements from Education Department regulations for the preceding fiscal year. SUMMARY OF SPECIFIC PROVISIONS : Amends Education Law to require regents to prescribe a formal process by which the department seeks input from school districts in developing commissioner's regulations. VALESKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law and the state finance law, in relation to increasing the transparency of the local impact of state policy- making THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 207-b to read as follows: S 207-B. REGULATORY PROCESS. THE REGENTS SHALL PRESCRIBE BY RULE A FORMAL PROCESS BY WHICH THE INPUT OF SCHOOL DISTRICTS OF THE STATE SHALL BE SOUGHT IN THE DEVELOPMENT OF THE COMMISSIONER'S REGULATIONS. SUCH INPUT SHALL INCLUDE BUT NOT BE LIMITED TO AN ESTIMATE OF THE COST TO SCHOOL DISTRICTS OF ANY NEW PROGRAM, PROJECT OR ACTIVITY THAT WILL BE MANDATED BY ANY SUCH REGULATION AND SHALL BE INCORPORATED INTO ANY REGU- LATORY IMPACT STATEMENT DEVELOPED IN RELATION TO SUCH REGULATION. S 2. Section 8 of the state finance law is amended by adding a new subdivision 21 to read as follows: 21. PREPARE AND PUBLISH, NO LATER THAN OCTOBER FIFTEENTH IN EACH YEAR, A REPORT AGGREGATING THE INFORMATION FROM FISCAL NOTES THAT ACCOMPANIED ANY BILL THAT BECAME A LAW PROVIDING FOR AN INCREASE OR DECREASE IN REVENUES OR MANDATING THE APPROPRIATION OR EXPENDITURE OF MONEYS IN ANY POLITICAL SUBDIVISION AND FROM REGULATORY IMPACT STATEMENTS OF RULES PROMULGATED BY THE STATE EDUCATION DEPARTMENT DURING THE PRECEDING YEAR, IN ORDER TO CALCULATE THE CUMULATIVE COST TO LOCAL GOVERNMENTS OF COMPLYING WITH NEW STATE MANDATES. A COPY OF SUCH REPORT SHALL BE FILED WITH THE SENATE FINANCE COMMITTEE AND THE ASSEMBLY WAYS AND MEANS COMMITTEE AND COPIES SHALL BE AVAILABLE TO ANY STATE AGENCY UPON REQUEST. S 3.
