BILL NUMBER: S607 TITLE OF BILL : An act to amend the social services law, in relation to requiring employees of certain child care facilities to be trained and certified in cardiopulmonary resuscitation PURPOSE : This legislation requires that during operating hours at least one employee of child care programs and child day care centers be certified in cardiopulmonary resuscitation (CPR). SUMMARY OF PROVISIONS : Section 390-a of the social services law is amended by adding a new subdivision 5. Currently day care providers and staff are mandated to have basic health and safety training, but CPR is not part of the required training. JUSTIFICATION : The welfare and safety of the children of New York is a primary concern. The Office of Children and Family Services (OCFS) encourages day care providers to take CPR courses, but law does not require them to, This bill would require that during operating hours, at least one CPR certified employee is present Accidents are the leading cause of death among infants and this bill would not only save lives, but

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Social Services, Children and Families AN ACT to amend the social services law, in relation to requiring employees of certain child care facilities to be trained and certified in cardiopulmonary resuscitation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 390-a of the social services law is amended by adding a new subdivision 5 to read as follows: 5. DURING OPERATING HOURS OF FAMILY DAY CARE HOMES, GROUP FAMILY DAY CARE HOMES, SCHOOL-AGE CHILD CARE PROGRAMS AND CHILD DAY CARE CENTERS, AT LEAST ONE EMPLOYEE SHALL HOLD A VALID CERTIFICATE OF COMPLETION OF A COURSE OF STUDY IN FIRST AID KNOWLEDGE AND SKILLS OFFERED BY THE AMERI- CAN NATIONAL RED CROSS AND APPROVED BY THE COMMISSIONER, OR MEET EQUIV- ALENT REQUIREMENTS AS CERTIFIED BY THE COMMISSIONER. ANY SUCH COURSE OF STUDY OR EQUIVALENT REQUIREMENTS SHALL INCLUDE INSTRUCTION IN THE ADMIN- ISTRATION OF CARDIOPULMONARY RESUSCITATION. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law, provided, however, that effective immediate- ly the amendment, addition, and/or repeal of any rule or regulation necessary for the timely implementation of this act on its effective date is hereby authorized and directed to be made on or before such effective date.
