AN  ACT  to  amend  the  social  services  law, in relation to requiring
  employees of certain child care facilities to be trained and certified
  in cardiopulmonary resuscitation

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  390-a  of  the social services law is amended by
adding a new subdivision 5 to read as follows:
  5. DURING OPERATING HOURS OF FAMILY DAY CARE HOMES, GROUP  FAMILY  DAY
CARE  HOMES,  SCHOOL-AGE CHILD CARE PROGRAMS AND CHILD DAY CARE CENTERS,
AT LEAST ONE EMPLOYEE SHALL HOLD A VALID CERTIFICATE OF COMPLETION OF  A
COURSE  OF STUDY IN FIRST AID KNOWLEDGE AND SKILLS OFFERED BY THE AMERI-
CAN NATIONAL RED CROSS AND APPROVED BY THE COMMISSIONER, OR MEET  EQUIV-
ALENT  REQUIREMENTS AS CERTIFIED BY THE COMMISSIONER. ANY SUCH COURSE OF
STUDY OR EQUIVALENT REQUIREMENTS SHALL INCLUDE INSTRUCTION IN THE ADMIN-
ISTRATION OF CARDIOPULMONARY RESUSCITATION.
  S 2. This act shall take effect on the one hundred twentieth day after
it shall have become a law, provided, however, that effective immediate-
ly the amendment, addition, and/or repeal  of  any  rule  or  regulation
necessary  for  the  timely  implementation of this act on its effective
date is hereby authorized and directed to be  made  on  or  before  such
effective date.
