BILL NUMBER: S6165 TITLE OF BILL : An act to amend the correction law, in relation to closure of facilities PURPOSE OR GENERAL IDEA OF BILL : To ensure that special housing units and correctional facility annexes receive the same 12-month notification by the commissioner of corrections that general facility closures receive. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends section 79-a of the correction law, as amended by section 1 of part H of the Chapter 56 of the laws of 2009 to read as follows: Before the closure of any correctional facility, which for purposes of this section shall include a correctional facility annex, or any special housing unit established to confine inmates in accordance with the provisions of subdivision six of section one hundred thirty-seven of this chapter. Section 2 provides that the act shall take effect immediately. JUSTIFICATION :

AUBERTINE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the correction law, in relation to closure of facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of section 79-a of the correction law, as amended by section 1 of part H of chapter 56 of the laws of 2009, is amended to read as follows: Before the closure of any correctional facility, WHICH FOR PURPOSES OF THIS SECTION SHALL INCLUDE A CORRECTIONAL FACILITY ANNEX, OR ANY SPECIAL HOUSING UNIT ESTABLISHED TO CONFINE INMATES IN ACCORDANCE WITH THE PROVISIONS OF SUBDIVISION SIX OF SECTION ONE HUNDRED THIRTY-SEVEN OF THIS CHAPTER, for reasons other than those set forth in paragraph (a) of subdivision eight of section forty-five of this chapter, the commission- er shall take the following actions: S 2.
