BILL NUMBER: S729 TITLE OF BILL : An act to amend the tax law, in relation to giving a credit against income tax for health facility or gymnasium membership PURPOSE : Provides for credit against personal income tax for membership in a health facility or gymnasium. SUMMARY OF PROVISIONS : Section 1. Section 606 of the tax law is amended by adding a new subsection (aaa) to state that after December 31st, 2008, a taxpayer shall be allowed a credit in the amount of fifty dollars for an individual membership and two hundred dollars for a family membership in a health facility or gymnasium. Section 2. This act shall take effect immediately. JUSTIFICATION : A tax credit toward the cost of gym memberships will encourage more people to become active, and get healthier. If even a small percentage of the population can use the tax credit as a motivator, it will pay for itself in health savings. Most areas of New York State have wonderful, community centers and fitness facilities. By supporting them, it puts money back into the community facilities and gives

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Investigations and Govern- ment Operations AN ACT to amend the tax law, in relation to giving a credit against income tax for health facility or gymnasium membership THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 606 of the tax law is amended by adding a new subsection (qq) to read as follows: (QQ) CREDIT FOR MEMBERSHIP IN A HEALTH FACILITY OR GYMNASIUM. (1) FOR YEARS BEGINNING AFTER DECEMBER THIRTY-FIRST, TWO THOUSAND NINE, A TAXPAYER SHALL BE ALLOWED A CREDIT IN THE AMOUNT OF FIFTY DOLLARS FOR AN INDIVIDUAL MEMBERSHIP AND TWO HUNDRED DOLLARS FOR A FAMILY MEMBERSHIP IN A HEALTH FACILITY OR GYMNASIUM. (2) FOR PURPOSES OF THIS SECTION "HEALTH FACILITY OR GYMNASIUM" MEANS ANY BUSINESS WHICH PROVIDES EXERCISE FACILITIES AND EQUIPMENT, PHYSICAL TRAINING AND HEALTH RELATED INSTRUCTION FOR THE PURPOSE OF INCREASING PHYSICAL FITNESS AND HEALTH OF ITS CUSTOMERS.
