BILL NUMBER: S757 TITLE OF BILL : An act in relation to authorizing the commissioner of environmental conservation to undertake projects to protect the Montauk Lighthouse from shore erosion PURPOSE OR GENERAL IDEA OF BILL : This legislation would allow the Department of Environmental Conservation to undertake certain projects to protect the Montauk Lighthouse, which is owned by the Montauk Historical Society, Inc., a not-for-profit corporation. SUMMARY OF SPECIFIC PROVISIONS : This is a special act authorizing the Department of Environmental Conservation to undertake any project to protect the Montauk Lighthouse from shore erosion, notwithstanding any other laws to the contrary. It makes no determination as to the best method to undertake such protection. JUSTIFICATION : The Montauk Lighthouse is a historically significant site on the east end of Long Island. Unfortunately, the area is seriously threatened by erosion.

THIELE -- read once and referred to the Committee on Environmental Conservation AN ACT in relation to authorizing the commissioner of environmental conservation to undertake projects to protect the Montauk Lighthouse from shore erosion THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding the provisions of section 1 of chapter 535 of the laws of 1945, as amended, the commissioner of environmental conservation shall also be authorized to undertake any project to protect the Montauk Lighthouse from shore erosion, notwithstanding the fact said lighthouse property is owned by the Montauk Historical Socie- ty, Inc., a not-for-profit corporation organized under the laws of the state of New York.
