BILL NUMBER: S792 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to exempting a motor vehicle with an automatic or remote car starter from certain prohibitions PURPOSE OF THE BILL : This legislation clarifies that it is legal for a person to start their motor vehicle with an automatic or remote car starter without being in violation of subdivision (a) of section 1210 of the vehicle and traffic law. SUMMARY OF PROVISIONS : Section 1. Subdivision (a) of section 1210 of the vehicle and traffic law, as amended by chapter 350 of laws 1967, is amended to clarify that this subdivision shall not apply to any motor vehicle with an automatic or remote car starter. Section 2. Effective Date. JUSTIFICATION : According to Subdivision (a) of section 1210 of the vehicle and traffic law, no person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine,

ALESI -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to exempting a motor vehicle with an automatic or remote car starter from certain prohibitions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (a) of section 1210 of the vehicle and traffic law, as amended by chapter 350 of the laws of 1967, is amended to read as follows: (a) No person driving or in charge of a motor vehicle shall permit it to stand unattended without first stopping the engine, locking the ignition, removing the key from the vehicle, and effectively setting the brake thereon and, when standing upon any grade, turning the front wheels to the curb or side of the highway, provided, however, the provision for removing the key from the vehicle shall not require the removal of keys hidden from sight about the vehicle for convenience or emergency; PROVIDED, FURTHER, THAT THE PROVISIONS OF THIS SUBDIVISION SHALL NOT APPLY TO ANY MOTOR VEHICLE WITH AN AUTOMATIC OR REMOTE CAR STARTER WHERE SUCH MOTOR VEHICLE IS ABLE TO REMAIN RUNNING WITH OR WITH- OUT KEYS IN THE IGNITION AND ALL OF THE DOORS TO SUCH MOTOR VEHICLE ARE LOCKED. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regu- lation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed on or before such effective date.
