BILL NUMBER:S7993 TITLE OF BILL: An act to amend the public authorities law, in relation to contracts entered into by the metropolitan transportation authority PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to limit rail facility leases to a maximum of twenty years and to prevent lessees who have violated the terms of their permit more than three times from renewing their permit. SUMMARY 0F SPECIFIC PROVISIONS: This legislation adds two new subparagaphs (i) and (ii) to section 1. Paragraph (a) of subdivision 6 of section 1265 of the public authorities law. JUSTIFICATION: With the increased reliance on rail to transport municipal waste, particularly in New York City, constituents have raised concerns regarding limited accountability for railroads. Their concerns are primarily related to quality of life issues (odors associated with municipal waste). Unwashed garbage transport rail cars and improperly sealed containers have dramatic impacts on the quality of life and the property values of citizens living near rail operations which carry municipal solid waste.

ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the public authorities law, in relation to contracts entered into by the metropolitan transportation authority THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 6 of section 1265 of the public authorities law, as amended by chapter 988 of the laws of 1984, is amended to read as follows: (a) To enter into contracts and leases and to execute all instruments necessary or convenient; PROVIDED, HOWEVER: (I) THAT CONTRACTS FOR THE LEASE OF ANY RAILROAD FACILITIES SHALL BE FOR A TERM NO LONGER THAN TWENTY YEARS; AND (II) ANY LESSEE SEEKING TO RENEW A CONTRACT FOR THE LEASE OF ANY RAIL- ROAD FACILITIES WHO HAS COMMITTED MORE THAN THREE VIOLATIONS OF ANY PERMIT ISSUED PURSUANT TO SECTION 27-0305 OF THE ENVIRONMENTAL CONSERVA- TION LAW, SHALL BE BARRED FROM SUCH RENEWAL; S 2.
