BILL NUMBER:S8160 TITLE OF BILL: An act to amend the civil rights law, in relation to prohibiting discrimination against New York state residents by places of public accommodation PURPOSE OF BILL: The purpose of this bill is to prohibit discrimination against New York state residents by places of public accommodation. SUMMARY OF PROVISIONS: Section one of this bill amends section 40-e of the civil rights law. It specifies that no owner, agent, or employee of any hotel, motel, or inn shall require any person to provide proof of out-of-state residency as a condition of rental of accommodation. It also specifies that no owner, manager, agent, or employee of any hotel, motel, or inn shall publish or display any communication that relates to the refusal of accommodation of any state resident. Section two sets out the effective date. JUSTIFICATION: Currently, many hotels require proof of out-of-state residency and rent rooms exclusively to visitors to New York. This bill would make it illegal to discriminate against New York state residents and deny

ADAMS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the civil rights law, in relation to prohibiting discrimination against New York state residents by places of public accommodation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 40-e of the civil rights law, as added by chapter 1031 of the laws of 1965, is amended to read as follows: S 40-e. Innkeepers and carriers refusing to receive guests and passen- gers. 1. A person, who, either on his own account or as agent or officer of a corporation, carries on business as innkeeper, or as common carrier of passengers, and refuses, without just cause or excuse, to receive and entertain any guest, or to receive and carry any passenger, is guilty of a misdemeanor. 2. NO OWNER, AGENT OR EMPLOYEE OF ANY HOTEL, MOTEL OR INN SHALL REQUIRE ANY PERSON TO PROVIDE PROOF OF OUT-OF-STATE RESIDENCY AS A CONDITION OF PERMITTING SUCH PERSON TO RENT ANY ROOM OR OTHER ACCOMMO- DATION AVAILABLE IN SUCH HOTEL, MOTEL OR INN. NO PERSON, BEING THE OWNER, MANAGER, AGENT OR EMPLOYEE OF ANY HOTEL, MOTEL OR INN SHALL PUBLISH, CIRCULATE, ISSUE, DISPLAY, POST OR MAIL ANY WRITTEN OR PRINTED COMMUNICATION, NOTICE OR ADVERTISEMENT TO THE EFFECT THAT ANY OF THE ACCOMMODATIONS, ADVANTAGES, FACILITIES AND PRIVILEGES OF ANY SUCH PLACE SHALL BE REFUSED, WITHHELD FROM OR DENIED TO ANY STATE RESIDENT.
