BILL NUMBER:S8243 TITLE OF BILL: An act to amend the public authorities law, in relation to reporting of illegal behavior by certain railroad companies PURPOSE OR GENERAL IDEA OF BILL: To require that the Metropolitan Transit Authority report any violations of state law perpetrated by New York and Atlantic Railway and CSX Railroad corporation. SUMMARY OF SPECIFIC PROVISIONS: Adds section 1269-h to the public authorities law, which requires that the Metropolitan Transit Authority to send a bi-annual report to the legislature and the governor detailing any violations of State law on the part of New York and Atlantic Railways and CSX Railroad Corporation, Inc. JUSTIFICATION: In Queens County, many citizens have raised concerns with how New York and Atlantic Railways and CSX Railroad corporation conduct business. These complaints frequently allege that the freight carriers are violating state law. Their concerns include potential violations of environmental laws, safety and security laws, labor laws and public health laws.

ADDABBO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public authorities law, in relation to reporting of illegal behavior by certain railroad companies THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public authorities law is amended by adding a new section 1269-h to read as follows: S 1269-H. REPORTING OF ILLEGAL BEHAVIOR BY CERTAIN RAILROAD COMPANIES. THE METROPOLITAN TRANSIT AUTHORITY SHALL ISSUE A BI-ANNUAL REPORT TO THE LEGISLATURE AND GOVERNOR THAT WILL DETAIL THE EXISTENCE OF ANY BEHAVIOR WHICH MAY CONSTITUTE VIOLATIONS OF STATE LAW THAT ARE COMMITTED BY THE NEW YORK AND ATLANTIC RAILWAY, OR CSX RAILROAD CORPORATION, INC.
