BILL NUMBER: S851 TITLE OF BILL : An act to amend the state finance law, in relation to the procurement and definition of certified wood PURPOSE : To create a program of preferred source status for procurement of certified wood and paper products. SUMMARY OF PROVISIONS : Section One amends section 165 of the state finance law adding two new paragraphs (k) and (1). Section (k) defines certified wood and establishes a program for the procurement of certified wood. Section (1) establishes, based on the results of the program for certified wood, a project for certified paper procurement. JUSTIFICATION : The State of New York and the New York Legislature, through their long continuing efforts as responsible parties with those practicing stewardship of the environment, encourage the use and purchase of certified wood and paper products. The State recognizes that there are a variety of different, credible sustainable forestry management programs in place or in development

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the state finance law, in relation to the procurement and definition of certified wood THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 165 of the state finance law is amended by adding two new paragraphs k and l to read as follows: K. THE COMMISSIONER SHALL IMPLEMENT A CERTIFIED WOOD PROGRAM, WHICH SPECIFIES CERTIFIED WOOD WHERE FEASIBLE. THE TERM "CERTIFIED WOOD" SHALL BE DEFINED AS WOOD-BASED MATERIALS SOURCED FROM FORESTLANDS OR PRODUCED BY COMPANIES PARTICIPATING IN AN ACCEPTABLE SYSTEM OR PROGRAM WHICH CERTIFIES SUSTAINABLE FOREST MANAGEMENT, AS DETERMINED BY THE COMMISSIONER IN CONSULTATION WITH THE COMMISSIONER OF THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION, OR HIS/HER DESIGNEE. ACCEPTABLE SYSTEMS OR PROGRAMS SHALL INCLUDE ALL OF THE FOLLOWING: (I) ADHERENCE TO MANAGEMENT PRACTICES WHICH CONSERVE BIOLOGICAL DIVERSITY, MAINTAIN PRODUCTIVE CAPACITY OF FOREST ECOSYSTEMS, MAINTAIN FOREST ECOSYSTEM HEALTH AND VITALITY, CONSERVE AND MAINTAIN SOIL AND WATER RESOURCES, AND MAINTAIN FOREST CONTRIBUTION TO GLOBAL CARBON CYCLES; (II) INDEPENDENT THIRD PARTY AUDITING THAT MONITORS, MEASURES AND REPORTS COMPLIANCE WITH SYSTEM OR PROGRAM PRINCIPLES AND GUIDELINES; AND (III) DOCUMENTATION VERIFYING THAT THE WOOD-BASED PRODUCTS ARE SOURCED FROM OR PRODUCED UNDER AN ACCEPTABLE CERTIFICATION SYSTEM OR PROGRAM. THE DEPARTMENT OF ENVIRONMENTAL CONSERVATION SHALL PROVIDE DOCUMENTATION ON THE SUCCESS OF IMPLEMENTING THE CERTIFIED WOOD PROCUREMENT POLICY IN THE ANNUAL REPORT MADE PURSUANT TO PARAGRAPH I OF THIS SUBDIVISION. L. PURSUANT TO THE RESULTS OF THE STATE WOOD CERTIFICATION PROGRAM, A PILOT PROJECT SHALL BE ESTABLISHED TO INCORPORATE CERTIFIED PAPER PROD- UCT.
