BILL NUMBER: S913 TITLE OF BILL : An act to amend the penal law, in relation to endangering the welfare of a child PURPOSE OF THE BILL : This bill would proscribe conduct by a parent or custodian which threatens to injure a member of a child's family. SUMMARY OF SPECIFIC PROVISIONS : The bill amends section 260.10 of the penal law "endangering the welfare of a child" by adding a new subdivision 1-a to provide that where a parent or guardian attempts to injure, threaten to injure, knowingly injures or engaged in conduct likely to injure a member of the child's family or household, that person can be charged with and may be found guilty of endangering the welfare of a child--a class A misdemeanor. JUSTIFICATION : Under current law a charge of Endangering the Welfare of a Child is sufficient if based upon the existence of domestic violence in the home. This amendment would further hold domestic violence offenders criminally accountable for their actions which impact on children. Studies have shown that violence in the home detrimentally impacts on

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to endangering the welfare of a child THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 260.10 of the penal law is amended by adding a new subdivision 1-a to read as follows: 1-A. BEING A PARENT, GUARDIAN OR OTHER PERSON LEGALLY CHARGED WITH THE CARE OR CUSTODY OF A CHILD LESS THAN EIGHTEEN YEARS OLD, HE OR SHE ATTEMPTS TO INJURE, THREATENS TO INJURE, KNOWINGLY INJURES, OR ENGAGES IN CONDUCT LIKELY TO INJURE A MEMBER OF THE CHILD'S FAMILY OR HOUSEHOLD; OR S 2.
