BILL NUMBER: S920 TITLE OF BILL : An act to amend the penal law, in relation to excluding child sexual abuse from the definition of the crime of incest PURPOSE : This bill defines the crime of incest to exclude child sexual abuse. SUMMARY OF PROVISIONS : Section 1 of this bill amends the first undesignated paragraph of section 255.25 of the penal law. Current law provides that a person is guilty of incest when "a person" engages in sexual intercourse with someone whom is closely related to them. This section deletes "a person" and replaces it with "an adult." Section 2 enacts this bill on the first of November next succeeding the date on which it shall become law. JUSTIFICATION : Currently, sex with a child under eleven is a Class B felony,

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to excluding child sexual abuse from the definition of the crime of incest THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The first undesignated paragraph of section 255.25 of the penal law, as amended by chapter 320 of the laws of 2006, is amended to read as follows: A person is guilty of incest in the third degree when he or she marries or engages in sexual intercourse, oral sexual conduct or anal sexual conduct with [a person] AN ADULT whom he or she knows to be related to him or her, whether through marriage or not, as an ancestor, descendant, brother or sister of either the whole or the half blood, uncle, aunt, nephew or niece. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
