BILL NUMBER: S940 TITLE OF BILL : An act to amend the public health law, in relation to the home based primary care for the elderly demonstration project PURPOSE OR GENERAL IDEA OF BILL : This bill is an amendment to chapter 633 of the laws of 2006 (A.11720-B). This will clarify that the demonstration relates to allowing for the provision of physician based services in patients' homes by selected providers. Nursing services are currently provided in patients' homes by Article 36 home health agencies. SUMMARY OF SPECIFIC PROVISIONS : This bill would amend Subdivision 1 of section 2820 of the public health law as added NY chapter 633 of the laws of 2006. JUSTIFICATION : Some of New York State's most experienced geriatricians work in nursing homes or for long term care providers that operate a continuum of programs both residential and in the community including nursing homes, residential communities and community based programs for the elderly. Currently, the state is actively encouraging nursing homes to down size and further push toward community based care. And, many nursing homes have responded by re-shaping the care delivery system to

ROBACH -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to the home based primary care for the elderly demonstration project THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 2820 of the public health law, as added by chapter 633 of the laws of 2006, is amended to read as follows: 1. Notwithstanding any law to the contrary there is hereby created a demonstration program within the department to determine the effective- ness of providing home based primary care services to elderly patients as part of an integrated program of long term care services. As part of the demonstration program a selected provider shall be authorized to provide physician, nurse-practitioner, AND physician assistant [and nursing] services in the home of patients age sixty-five or older and to other patients eligible for benefits pursuant to title XVIII of the federal social security act. S 2. This act shall take effect immediately, provided, however, that the amendments to section 2820 of the public health law made by section one of this act shall not affect the repeal of such section and shall expire and be deemed repealed therewith.
