BILL NUMBER: S953 TITLE OF BILL : An act requiring resolutions be passed prior to the metropolitan transportation authority's approval for improvements to the mainline railroad track for the purposes of building a third track PURPOSE OF BILL : To provide the localities which would be affected by the implementation of a third track on the Long Island Railroad line to have the opportunity to approve or disapprove such action. SUMMARY OF SPECIFIC PROVISIONS : Section 1 precludes the Metropolitan Transportation Authority (MTA) from approving any changes to the mainline railroad track, for the purposes of building a third track, until the following communities adopt a resolution approving such project: * Bellerose Village * Floral Park * Garden City * New Hyde Park

JOHNSON, DIAZ, ONORATO -- read twice and ordered printed, and when printed to be committed to the Committee on Trans- portation AN ACT requiring resolutions be passed prior to the metropolitan trans- portation authority's approval for improvements to the mainline rail- road track for the purposes of building a third track THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The metropolitan transportation authority shall be precluded from approving any improvements to the mainline railroad track, for the purposes of building a third track, through the communi- ties of Bellerose Village, Floral Park, Garden City, New Hyde Park, Mineola, Westbury, town of Hempstead, town of North Hempstead and the town of Oyster Bay until the following conditions have been met: (a) The board of trustees of the villages of Bellerose, Floral Park, Garden City, New Hyde Park, Mineola and Westbury and the towns of Hemp- stead, North Hempstead and Oyster Bay shall approve a resolution approv- ing the mainline third track improvement project by the metropolitan transportation authority. (b) The aforementioned village and town boards shall hold at least one public meeting prior to considering the resolutions required in subdivi- sion (a) of this section. S 2. The metropolitan transportation authority shall be precluded from approving any improvements to the mainline railroad track, for the purposes of building a third track, unless two-thirds of the aforemen- tioned village and town boards adopt the resolution required in section one of this act.
