LENTOL -- read once and referred to the Committee on Governmental Employees AN ACT to amend the general municipal law and the administrative code of the city of New York, in relation to service by police officers in an undercover capacity THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 208-h to read as follows: S 208-H. SERVICE IN AN UNDERCOVER CAPACITY; LIMITATION. NOTWITHSTAND- ING THE PROVISIONS OF ANY GENERAL, SPECIAL OR LOCAL LAW OR ANY RULE OR REGULATION OF ANY POLICE DEPARTMENT OR COMMISSIONER OR HEAD THEREOF, A MEMBER OF A POLICE FORCE, INCLUDING POLICE DETECTIVES, SHALL NOT BE REQUIRED TO SERVE IN AN UNDERCOVER ASSIGNMENT OR CAPACITY FOR A PERIOD OF TIME WHICH EXCEEDS THIRTY-SIX MONTHS. SUCH TIME LIMIT SHALL BE THE AGGREGATE OF ALL SERVICE UNDER ANY TITLE, POSITION OR APPOINTMENT. S 2. The administrative code of the city of New York is amended by adding a new section 14-117.1 to read as follows: S 14-117.1 SERVICE IN AN UNDERCOVER CAPACITY; LIMITATION. NOTWITH- STANDING ANY INCONSISTENT PROVISION OF LAW, RULE OR REGULATION OF THE DEPARTMENT OR THE COMMISSIONER, A MEMBER OF THE POLICE FORCE, INCLUDING POLICE DETECTIVES, SHALL NOT BE REQUIRED TO SERVE IN AN UNDERCOVER ASSIGNMENT OR CAPACITY FOR A PERIOD OF TIME WHICH EXCEEDS THIRTY-SIX MONTHS. SUCH TIME LIMIT SHALL BE THE AGGREGATE OF ALL SERVICE UNDER ANY TITLE, POSITION OR APPOINTMENT. S 3. This act shall take effect immediately.
