AN ACT to amend the vehicle and traffic law, in  relation  to  passenger
  registration of pickup trucks

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 401 of the vehicle and traffic law  is  amended  by
adding a new subdivision 16-a to read as follows:
  16-A. PICKUP TRUCKS. NOTWITHSTANDING ANY OTHER PROVISION OF THIS CHAP-
TER  OR  OTHER  LAW,  RULE,  OR REGULATION, A PICKUP TRUCK WHICH IS USED
EXCLUSIVELY FOR NON-COMMERCIAL PURPOSES SHALL,  AT  THE  OPTION  OF  THE
REGISTRANT,  BE CLASSIFIED AS A PASSENGER VEHICLE AND REGISTERED ACCORD-
INGLY. FOR PURPOSES OF THIS SUBDIVISION, PICKUP  TRUCK  SHALL  MEAN  ANY
TRUCK,  REGARDLESS  OF  WEIGHT,  WHICH  HAS  A CARGO BED AND SIDE WALLS,
REGARDLESS OF SEATING CAPACITY WITHIN THE CAB. NOTHING IN  THIS  SECTION
SHALL PRECLUDE THE REGISTRATION OF A PICKUP TRUCK AS A PASSENGER VEHICLE
SOLELY  BECAUSE SUCH PICKUP TRUCK IS DRIVEN TO AND FROM THE REGISTRANT'S
PLACE OF EMPLOYMENT.
  S 2. This act shall take effect on the sixtieth  day  after  it  shall
have  become  law;  provided,  however,  that effective immediately, the
addition, amendment and/or repeal of any rule  or  regulation  necessary
for  the  implementation of this act on its effective date is authorized
and directed to be made and completed on or before such effective date.
