SWEENEY -- read once and referred to the Commit- tee on Education AN ACT to provide for the payment of public high cost excess cost aid for the 2008-2009 school year to the Wyandanch union free school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding the provisions in subdivision 5 of section 3602 of the education law or any other provision of law to the contrary, with regard to the payment of public high cost excess cost aid for the 2008-2009 school year to the Wyandanch union free school district, the failure of such school district to timely apply therefor shall not be deemed to prohibit or impede the education department from making payment of such aid in a timely manner. The education department shall pay such public high cost excess cost aid to the Wyandanch union free school district for the 2008-2009 school year from supplemental aid payable during the 2011-2012 state fiscal year, and such aid shall be paid to such school district prior to the payment of supplemental aid to any other school district after the effective date of this act.
