AN ACT to amend the executive law, in relation to the statewide  certif-
  ication  program for participation by minority group members and women
  with respect to state contracts

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subparagraph  (vi) of paragraph (a) of subdivision 2-a of
section 314 of the executive law, as amended by chapter 175 of the  laws
of 2010, is amended to read as follows:
  (vi)  be  owned  by  an  individual  or  individuals, whose ownership,
control and operation are relied upon for certification, with a personal
net worth that does not  exceed  three  million  five  hundred  thousand
dollars,  as  adjusted  annually for inflation according to the consumer
price index; PROVIDED, HOWEVER, THAT THE PROVISIONS OF THIS SUBPARAGRAPH
SHALL ONLY APPLY TO MINORITY AND WOMEN-OWNED BUSINESS ENTERPRISES CERTI-
FIED AFTER OCTOBER THIRTEENTH, TWO THOUSAND TEN; and
  S 2. This act shall take effect immediately provided that  the  amend-
ments  to  section  314 of the executive law made by section one of this
act shall be subject to the expiration and  reversion  of  such  section
pursuant  to section 121 of chapter 261 of the laws of 1998, as amended,
and shall be deemed to expire therewith.

AN  ACT to amend the executive law, in relation to the statewide certif-
  ication program for participation by minority group members and  women
  with  respect to state contracts, and providing for the repeal of such
  provisions upon expiration thereof

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.  Paragraph (e) of subdivision 7 and paragraph (e) of subdi-
vision  15  of section 310 of the executive law, as added by chapter 175
of the laws of 2010, are amended to read as follows:
  (e) an enterprise owned by an individual or individuals, whose  owner-
ship,  control  and  operation are relied upon for certification, with a
personal net worth that does not exceed three million five hundred thou-
sand dollars, as adjusted annually on the first of January for inflation
according to the consumer price index of the  previous  year,  PROVIDED,
HOWEVER,  THAT  THE  PROVISIONS  OF  THIS  PARAGRAPH SHALL ONLY APPLY TO
MINORITY-OWNED BUSINESS ENTERPRISES CERTIFIED AFTER OCTOBER  THIRTEENTH,
TWO THOUSAND TEN; and
  (e)  an enterprise owned by an individual or individuals, whose owner-
ship, control and operation are relied upon for  certification,  with  a
personal net worth that does not exceed three million five hundred thou-
sand dollars, as adjusted annually on the first of January for inflation
