ABINANTI -- read once and referred to the Commit- tee on Consumer Affairs and Protection AN ACT to amend the general business law, in relation to the right to contract for the burial of pet remains and cremated remains THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 750-d of the general business law is amended by adding a new subdivision 3 to read as follows: 3. NO RULE OR REGULATION OF ANY DEPARTMENT, BOARD OR AGENCY OF THE STATE SHALL INTERFERE WITH THE RIGHT OF ANY PERSON OPERATING PURSUANT TO THIS ARTICLE TO CONTRACT WITH A PET OWNER FOR THE BURIAL OF PET REMAINS AND CREMATED REMAINS AS DEFINED IN SUBDIVISION TWO OF SECTION FORTY-TWO HUNDRED TWO OF THE PUBLIC HEALTH LAW. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD13385-01-1
