LANCMAN -- read once and referred to the Commit- tee on Judiciary AN ACT to amend the civil practice law and rules, in relation to enact- ing the "civil practice medical records production act" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Short title. This act shall be known and may be cited as the "civil practice medical records production act". S 2. Subdivision (c) of section 8001 of the civil practice law and rules is amended to read as follows: (c) [Transcripts] PRODUCTION of PAPER records AND/OR DOCUMENTS. [Wherever] NOTWITHSTANDING ANY OTHER PROVISION OF LAW RELATING TO FEES FOR THE PRODUCTION OF PAPER RECORDS AND/OR DOCUMENTS WHENEVER the [prep- aration of a transcript] PRODUCTION of PAPER records AND/OR DOCUMENTS is required in order to comply with a subpoena, the person subpoenaed shall receive an additional fee of ten cents per [folio] PAGE upon demand, IN ADDITION TO ANY SUCH ATTENDANCE FEE AND/OR TRAVEL EXPENSES WHICH THE PERSON SUBPOENAED MIGHT BE ELIGIBLE TO RECEIVE FOR THEIR ACTUAL ATTEND- ANCE.
