AN ACT to amend the public authorities law, in relation to requiring the
  metropolitan transportation authority to utilize existing real proper-
  ty under its control prior to leasing or otherwise acquiring new prop-
  erty for use as office space

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 7 of section 1265  of  the  public  authorities
law,  as added by chapter 324 of the laws of 1965, is amended to read as
follows:
  7. To acquire, hold and dispose of real or personal  property  in  the
exercise of its powers; PROVIDED, HOWEVER, SUCH AUTHORITY SHALL UNDER NO
CIRCUMSTANCES LEASE OR OTHERWISE ACQUIRE ANY REAL PROPERTY OR ANY INTER-
EST  THEREIN  FOR  USE  AS OFFICE SPACE, UNLESS IT IS DETERMINED THAT NO
REAL PROPERTY CURRENTLY UNDER THE CONTROL OF SUCH  AUTHORITY,  WHICH  IS
SUITABLE FOR SUCH USE, IS AVAILABLE;
  S 2. This act shall take effect immediately.
