BILL NUMBER:S2260 TITLE OF BILL: An act in relation to appointment of certain nonjudicial officers and employees of the unified court system PURPOSE OF THE BILL: To provide title protection for five training academy officers. JUSTIFICATION: In 1988, the legislature passed and the Governor signed into law legislation that "grandfathered" in certain Senior Court Officers, who received supplemental compensation in recognition of special supervisory duties, into a new civil service title Senior Court Officer Sergeant. The training academy officers, who received the same compensation, were excluded from the bill. Although these officers received the same compensation, they didn't receive the title or line. Under this bill, should the five training officers leave the academy, they would be guaranteed the rightful title of Senior Court Officer Sergeant.

KRUGER -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT in relation to appointment of certain nonjudicial officers and employees of the unified court system THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Legislative findings and intent. The legislature hereby finds that it has long been the practice that certain nonjudicial offi- cers and employees of the unified court system in court security posi- tions received supplemental compensation in the form of collectively bargained assignment differentials. This compensation has been paid in recognition of the special supervisory duties performed by such nonjudi- cial officers and employees. The legislature further finds that the chief administrator of the courts eliminated this practice, and trans- ferred the duties heretofore performed by court security personnel receiving assignment differentials to the holders of special court secu- rity positions classified in the competitive class. The legislature also finds that the instructors for the training academy for court security within the city of New York, who received assignment differentials for the performance of supervisory duties, have served more than five and, in some instances, more than ten years in their positions; and that these incumbents, by their training and experience in their positions, have acquired invaluable expert knowledge and skill in the performance of their duties on behalf of the court system and the administration of justice. Accordingly, the legislature hereby declares that it is essen- tial that means be provided to continue as permanent appointees security positions having supervisory responsibilities within the city of New York qualified incumbents of court security positions already performing such supervisory duties. It is the purpose of this act, therefore, to provide an orderly method for continuing these incumbents in service with the rights and tenure of permanent appointees.
