  KLEIN, KRUEGER, KRUGER,  MONTGOMERY,  OPPENHEIMER,  SAMPSON,  SERRANO,
  SMITH,  VALESKY -- read twice and ordered printed, and when printed to
  be committed to the Committee on Labor

AN ACT to amend the labor law, in relation to  authorizing  the  commis-
  sioner  of  labor  to  implement  rules and regulations concerning the
  removal of lead, asbestos and other hazardous wastes

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section  902  of the labor law is amended by adding a new
subdivision 6 to read as follows:
  6. (A) THE COMMISSIONER SHALL ESTABLISH RULES AND REGULATIONS  REGARD-
ING THE LICENSING AND CERTIFICATION OF THE REMOVAL OF LEAD, ASBESTOS AND
OTHER  HAZARDOUS  MATERIALS. SUCH RULES AND REGULATIONS SHALL BE PROMUL-
GATED ON OR BEFORE JANUARY FIRST NEXT SUCCEEDING THE EFFECTIVE  DATE  OF
THIS SUBDIVISION.
  (B)  ANY  PERSON WHO HELD A VALID LICENSE OR CERTIFICATE REGARDING THE
REMOVAL OF LEAD, ASBESTOS OR OTHER HAZARDOUS MATERIAL PRIOR  TO  JANUARY
FIRST  IN  THE  YEAR  PRECEDING  THE EFFECTIVE DATE OF THIS SUBDIVISION,
SHALL NOT BE SUBJECT TO THE RULES AND REGULATIONS  ESTABLISHED  PURSUANT
TO  PARAGRAPH (A) OF THIS SUBDIVISION, BUT SHALL CONTINUE TO BE GOVERNED
BY ANY RULE OR REGULATION THAT WAS ESTABLISHED  PRIOR  TO  THE  DATE  OF
PROMULGATION  OF  THE RULES AND REGULATIONS REQUIRED BY PARAGRAPH (A) OF
THIS SUBDIVISION.
  S 2. This act shall take effect immediately.
