BILL NUMBER:S3795 TITLE OF BILL: An act to amend the education law, in relation to transportation of certain pupils PURPOSE: To provide transportation for students within a school district to a non-public school located more than fifteen miles from the home of a pupil provided that the parents reimburse the district for the incremental cost associated with the additional segment of travel. SUMMARY OF PROVISIONS: The Board of Education may, at its discretion, provide transportation for pupils residing within the district to a non-public school located more than fifteen miles from the home of the pupil provided that the parents reimburse the district for the incremental cost associated with the pupil's residence and the fifteen-mile point shall be an ordinary contingent expense of the school district. JUSTIFICATION: If the parents are willing to pay the additional cost of transporting their child to a non-public school further than the fifteen-mile limit established by the school district, the parents should have the option of sending their child to the school of choice as long as the

LAVINE -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to transportation of certain pupils THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph b of subdivision 1 of section 3635 of the educa- tion law is amended by adding a new subparagraph (iii) to read as follows: (III) A BOARD OF EDUCATION MAY, AT ITS DISCRETION, PROVIDE TRANSPORTA- TION FOR PUPILS RESIDING WITHIN THE DISTRICT WHO ARE NOT ENTITLED TO TRANSPORTATION PURSUANT TO SUBPARAGRAPH (I) OR (II) OF THIS PARAGRAPH OR ANY OTHER PROVISION OF THIS CHAPTER TO A NONPUBLIC SCHOOL LOCATED MORE THAN FIFTEEN MILES FROM THE HOME OF ANY SUCH PUPIL PROVIDED THAT THE PARENTS OF SUCH PUPIL REIMBURSE THE DISTRICT FOR THE INCREMENTAL COST ASSOCIATED WITH THE SEGMENT OF TRAVEL IN EXCESS OF FIFTEEN MILES OR SUCH GREATER MILEAGE LIMIT APPROVED BY THE QUALIFIED VOTERS OF THE DISTRICT.
