BILL NUMBER:S4896 TITLE OF BILL: An act to amend the executive law, in relation to requiring the display of the prisoner of war/missing in action flag at every public building at which the flag of the United States of America is displayed PURPOSE: Requires the POW/MIA flag to be displayed at every state and local public building at which the flag of the United States of America is displayed. SUMMARY OF PROVISIONS: Section 1. Section 403-a of the executive law (Display of prisoner of war and missing in action flag), as amended by chapter 411 of the laws of 2005, is amended to state that the prisoner of war and missing in action flag at the building housing its local legislative body on all days shall be displayed at every public buildings facility at which the flag of the United States of America is displayed. JUSTIFICATION: The POW/MIA is generally displayed beneath the United States Flag six times per year: Armed Forces Day (Third Saturday in May), Memorial Day (Last Monday in May), Flag Day (June 14),

BALL -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to requiring the display of the prisoner of war/missing in action flag at every public building at which the flag of the United States of America is displayed THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 403-a of the executive law, as amended by chapter 411 of the laws of 2005, is amended to read as follows: S 403-a. Display of prisoner of war and missing in action flag. [1. Every county outside the city of New York, city, town, and village is encouraged to display the] THE prisoner of [war and missing] WAR/MISSING in action flag [at the building housing its local legislative body on all days on] SHALL BE DISPLAYED AT EVERY PUBLIC BUILDING FACILITY AT which the flag [of the United States of America] is displayed. [2. Every state police facility, including but not limited to the headquarters, substations, and training academy, is encouraged to display the prisoner of war and missing in action flag on all days on which the flag of the United States of America is displayed.] S 2.
