BILL NUMBER:S6318 TITLE OF BILL: An act to amend the labor law, in relation to leave for organ or bone marrow donation granted to state employees PURPOSE: To extend the scope of Chapter 214 of the Laws of2001 to include state workers who made an organ or bone marrow donation up to one year prior to August 29, 2001. SUMMARY OF PROVISIONS: Section 202-b of the Labor Law is amended by adding a new subdivision 4. The provision requires retroactive eligibility for up to one year prior within the context of the section, which permits state employees to take up to seven days paid leave for bone marrow donation and 30 days paid leave for organ donation. JUSTIFICATION: In 2001, the Governor signed legislation into law permitting state employees to take up to seven days paid leave for bone marrow donation and 30 days paid leave for organ donation. Upon learning of the probability that such legislation would be proposed and favorably considered, many state workers who were already scheduled for such transplants expressed a desire to postpone the procedure in order to

LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the labor law, in relation to leave for organ or bone marrow donation granted to state employees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 202-b of the labor law is amended by adding a new subdivision 4 to read as follows: 4. THE PROVISIONS OF THIS SECTION SHALL APPLY RETROACTIVELY TO ANY EMPLOYEE THAT HAS MADE A BONE MARROW OR ORGAN DONATION NO MORE THAN ONE YEAR PRIOR TO AUGUST TWENTY-NINTH, TWO THOUSAND ONE. S 2. This act shall take effect immediately and shall be deemed to be in full force and effect as of August 29, 2001.
