BILL NUMBER:S7313 TITLE OF BILL: An act to amend the environmental conservation law, in relation to amending the liquified natural and petroleum gas act to exempt the storage and transportation of small quantities of liquified natural gas used as a transportation fuel or a replacement for diesel PURPOSE: To amend the liquefied natural and petroleum gas act to exempt the storage and transportation of small quantities of liquefied natural gas (LNG) to facilitate LNG fueling and the use of LNG as a replacement for diesel. SUMMARY OF PROVISIONS: Section 1 amends section 23-1706 of the environmental conservation law to provide an exemption for the storage of up to 50,000 gallons of LNG and associated transportation activities provided that all transportation and storage activities conform to federal regulations and codes administered by the National Fire Protection Association. Section 2 is the effective date.

MAZIARZ -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to amending the liquified natural and petroleum gas act to exempt the storage and transportation of small quantities of liquified natural gas used as a transportation fuel or a replacement for diesel THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 23-1706 to read as follows: S 23-1706. EXEMPTIONS. NOTWITHSTANDING ANYTHING IN THIS ACT TO THE CONTRARY, THIS ACT SHALL NOT APPLY TO ANY LIQUIFIED NATURAL GAS FACILITY WITH A COMBINED STORAGE CAPACITY OF FIFTY THOUSAND GALLONS OR LESS THAT IS UTILIZED SOLELY FOR THE PURPOSE OF FUELING VEHICLES OR TO PROVIDE A REPLACEMENT FOR DIESEL FUEL THAT IS LOCATED OUTSIDE OF ANY CITY HAVING A POPULATION OF ONE MILLION OR MORE, AND ALL TRANSPORTATION ACTIVITIES ASSOCIATED WITH ANY SUCH FACILITY, PROVIDED THAT ALL SUCH FACILITIES AND TRANSPORTATION ACTIVITIES SHALL COMPLY WITH FEDERAL REGULATIONS AND NATIONAL FIRE PROTECTION ASSOCIATION CODES AND STANDARDS APPLICABLE TO THE STORAGE AND TRANSPORTATION OF LIQUIFIED NATURAL GAS.
