BILL NUMBER: S860 TITLE OF BILL : An act to direct the department of transportation to retain jurisdiction over and continue to maintain the state route 219 bridge over Cattaraugus Creek/Zoar Valley, in the counties of Cattaraugus and Erie PURPOSE : Directs the NYS Department of Transportation to retain jurisdiction and maintenance for the route 219 bridge (bridge identification number 1041590) which traverses Cattaraugus Creek and Zoar Valley. SUMMARY OF PROVISIONS : NYS Unconsolidated Law is amended to direct the NYS Department of Transportation to retain jurisdiction and responsibility for the maintenance of the State Route 219 bridge (bridge identification number 1041590) that crosses Cattaraugus Creek and Zoar Valley in the Counties of Cattaraugus and Erie. JUSTIFICATION : In response to the NYS Department of Transportation (DOT) attempting to divest itself of the Route 219 bridge (BIN 1041590) at the expense of Cattaraugus and Erie Counties, this legislation directs the NYS DOT to retain jurisdiction and maintenance

YOUNG -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to direct the department of transportation to retain jurisdiction over and continue to maintain the state route 219 bridge over Catta- raugus Creek/Zoar Valley, in the counties of Cattaraugus and Erie THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law, rule or regulation to the contrary, the department of transportation is hereby authorized and directed to retain jurisdiction over and the responsibility for the maintenance of the state route two hundred nineteen bridge (bridge iden- tification number 1041590) that crosses the Cattaraugus Creek/Zoar Valley in the counties of Cattaraugus and Erie. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD02496-01-1
