  Englebright, Ramos) -- (at request of the Division of Military & Naval
  Affairs) -- read once and referred to the  Committee  on  Governmental

AN  ACT to amend the military law, in relation to the appointment of the
  commander of the New York air national guard

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 3 of section 40 of the military law, as amended
by chapter 731 of the laws of 1958, is amended to read as follows:
  3.  The  New  York  air national guard shall be commanded by a general
officer who shall be  federally  recognized  or  qualified  for  federal
recognition  in a grade not below that of brigadier general, and who has
received an  aeronautical  rating  [as  a  pilot  of  service  types  of
aircraft].
  S 2. This act shall take effect immediately.
