AN ACT to amend the  environmental  conservation  law,  in  relation  to
  amending  the  liquified  natural  and petroleum gas act to exempt the
  storage and transportation of small quantities  of  liquified  natural
  gas

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The environmental conservation law is amended by  adding  a
new section 23-1706 to read as follows:
S 23-1706. EXEMPTIONS.
  THIS  ACT SHALL NOT APPLY TO ANY LIQUIFIED NATURAL GAS FACILITY WITH A
COMBINED STORAGE CAPACITY OF FORTY THOUSAND  GALLONS  OR  LESS  THAT  IS
LOCATED  OUTSIDE OF ANY CITY HAVING A POPULATION OF ONE MILLION OR MORE,
PROVIDED THAT THE  FACILITY  AND  ASSOCIATED  TRANSPORTATION  ACTIVITIES
SHALL  COMPLY WITH NATIONAL FIRE PROTECTION ASSOCIATION CODES AND STAND-
ARDS APPLICABLE TO THE STORAGE AND TRANSPORTATION OF  LIQUIFIED  NATURAL
GAS.
  S 2. This act shall take effect immediately.
