AN  ACT  to  amend  the tax law, in relation to exempting from sales and
  compensating use tax the receipts  from  the  rental  of  pallets  and
  containers used to ship goods for resale

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 1115 of the tax law is  amended  by  adding  a  new
subdivision (gg) to read as follows:
  (GG) RECEIPTS FROM THE RENTAL OF PALLETS AND CONTAINERS USED TO TRANS-
PORT  TANGIBLE  PERSONAL  PROPERTY  FOR  RESALE SHALL BE EXEMPT FROM THE
TAXES IMPOSED BY THIS ARTICLE.
  S 2. This act shall take effect on the first  day  of  the  sales  tax
quarterly  period,  as  designated in subdivision (b) of section 1136 of
the tax law, commencing at least 63 days after the date this  act  shall
have  become  a law and shall apply to rentals accruing on or after such
effective date.
