  to the Committee on Environmental Conservation

AN  ACT  to  amend  the  general business law, in relation to the use of
  plastic bags by supermarket or grocery store chains with five or  more
  stores

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1.   The general business law  is  amended  by  adding  a  new
section 399-j to read as follows:
  S  399-J.  USE  OF  DISPOSABLE,  PLASTIC  BAGS.  1. ANY SUPERMARKET OR
GROCERY STORE WITH FIVE OR MORE STORES IN A CHAIN SHALL CONDUCT TRAINING
FOR ALL EMPLOYEES WHO WORK ON A CHECKOUT LINE AND/OR  CASH  REGISTER  TO
DEVELOP  AWARENESS ABOUT THE AMOUNT OF DISPOSABLE, PLASTIC BAGS USED PER
ORDER AND TO KEEP THE DISTRIBUTION WITHIN REASONABLE LIMITS. SUCH TRAIN-
ING SHALL INCLUDE, BUT NOT BE LIMITED TO, REUSING BRAND NEW  DISPOSABLE,
PLASTIC  BAGS  THAT  A CUSTOMER DECLINES INSTEAD OF THROWING THEM IN THE
TRASH AND WHAT CONSTITUTES REASONABLE USE  LIMITS  OF  SUCH  DISPOSABLE,
PLASTIC BAGS.
  2.  ANY  VIOLATION  OF  THIS  SECTION WHERE ANY SUPERMARKET OR GROCERY
STORE CHAIN OF FIVE STORES OR MORE FAILS TO CONDUCT SUCH TRAINING  SHALL
RECEIVE  A  FINE OF ONE HUNDRED DOLLARS AND FIVE HUNDRED DOLLARS FOR ANY
SUBSEQUENT VIOLATION FOR REPEATED FAILURE TO CONDUCT TRAINING.
  S 2. This act shall take effect immediately.
