Repeals a provision which provides that an insurer shall not be liable for any loss sustained or contracted in consequence of the insured's being intoxicated or under the influence of any narcotic unless administered on the advice of the physician; this provision allowed insurers to deny payment for the medical treatment of such individuals.

DINOWITZ, GOTTFRIED, BRENNAN, ORTIZ, GALEF, MILL- MAN -- read once and referred to the Committee on Insurance AN ACT to repeal subparagraph (K) of paragraph 2 of subsection (d) of section 3216 of the insurance law THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (K) of paragraph 2 of subsection (d) of section 3216 of the insurance law is REPEALED. S 2. This act shall take effect immediately. REPEAL NOTE.--Subparagraph (K) of paragraph (2) of subsection (d) of section 3216 of the insurance law, proposed to be repealed by section one of this act, provides that an insurer shall not be liable for any loss sustained or contracted in consequence of the insured's being intoxicated or under the influence of any narcotic unless administered on the advice of the physician.
