2011-A402 (ACTIVE) - Summary

Provides that for notices of parking violations issued before September 1, 2012, if any information on the notice of violation is omitted, misdescribed, or illegible, the parking violation shall be dismissed upon application by the person charged; for those notices after September 1, 2011, if any information is omitted, misdescribed, or illegible, the hearing officer shall enter an order dismissing the violation.

AN ACT to amend the vehicle and traffic law, in relation to adjudication
  of certain parking infractions

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (b) of subdivision 2-a  of  section  238  of  the
vehicle and traffic law, as added by chapter 224 of the laws of 1995, is
amended to read as follows:
  (b)  [If  any] FOR NOTICES OF VIOLATION ISSUED BEFORE SEPTEMBER FIRST,
TWO THOUSAND TWELVE, IF ANY information which is required to be inserted
on a notice of violation  is  omitted  from  the  notice  of  violation,
misdescribed, or illegible, the violation shall be dismissed upon appli-
cation  of  the  person  charged  with  the  violation.  FOR  NOTICES OF
VIOLATION ISSUED ON OR AFTER SEPTEMBER FIRST, TWO  THOUSAND  TWELVE,  IF
ANY  INFORMATION  WHICH  IS  REQUIRED  TO  BE  INSERTED  ON  A NOTICE OF
VIOLATION IS OMITTED FROM THE  NOTICE  OF  VIOLATION,  MISDESCRIBED,  OR
ILLEGIBLE,  THE  HEARING  OFFICER  SHALL  ENTER  AN ORDER DISMISSING THE
VIOLATION.
  S 2. This act shall take effect immediately.
