S T A T E O F N E W Y O R K ________________________________________________________________________ 9146 I N A S S E M B L Y January 27, 2012 ___________ Introduced by M. of A. RUSSELL -- read once and referred to the Commit- tee on Codes AN ACT to amend the penal law, in relation to counseling for victims of sex offenses THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 60.27 of the penal law is amended by adding a new subdivision 15 to read as follows: 15. IF THE OFFENSE OF WHICH A PERSON IS CONVICTED IS DEFINED IN ARTI- CLE ONE HUNDRED THIRTY OF THIS CHAPTER, AND THE VICTIM OF SUCH OFFENSE OPTS FOR ANY TYPE OF COUNSELING, INCLUDING, BUT NOT LIMITED TO COUN- SELING FROM A RAPE CRISIS INTERVENTION AND PREVENTION PROGRAM AS AUTHOR- IZED PURSUANT TO ARTICLE SIX-A OF THE PUBLIC HEALTH LAW, THE COURT SHALL, UPON CONVICTION, IN ADDITION TO ANY OTHER SENTENCE, DIRECT THE DEFENDANT TO PAY THE COSTS OF COUNSELING. S 2. This act shall take effect on the ninetieth day after it shall have become a law, provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed on or before such effective date.
