GABRYSZAK -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to making the luring or enticing of a child a crime THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 260.08 to read as follows: S 260.08 CRIMINAL LURING OR ENTICING OF A CHILD. A PERSON IS GUILTY OF CRIMINAL LURING OR ENTICING OF A CHILD WHEN: 1. HE OR SHE FALSELY REQUESTS HELP OR PROMISES A REWARD TO A CHILD WITH THE INTENT TO BRING HARM TO THE PHYSICAL, MENTAL OR MORAL WELFARE OF THE CHILD; OR 2. HE OR SHE KNOWINGLY LURES A CHILD INTO AN AREA OR ENTICES A CHILD INTO AN ACT BY FALSELY REQUESTING HELP OR PROMISING A REWARD, WHERE SUCH AREA OR ACT IS LIKELY TO LEAD TO AN INJURY TO THE PHYSICAL, MENTAL OR MORAL WELFARE OF SUCH CHILD. CRIMINAL LURING OR ENTICING OF A CHILD IS A CLASS B FELONY. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
