MILLER, CRESPO -- Multi-Sponsored by -- M. of A. ARROYO, GABRYSZAK, GIBSON, McENENY -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to requiring certain school staff members to be trained in the Heimlich maneuver THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 907 to read as follows: S 907. HEIMLICH MANEUVER. 1. NO LATER THAN ONE HUNDRED EIGHTY DAYS AFTER THE EFFECTIVE DATE OF THIS SECTION, SCHOOL DISTRICTS, BOARDS OF COOPERATIVE EDUCATIONAL SERVICES, COUNTY VOCATIONAL EDUCATION AND EXTEN- SION BOARDS AND CHARTER SCHOOLS SHALL REQUIRE AT LEAST ONE STAFF MEMBER IN EVERY SCHOOL BUILDING, FACILITY OR ANNEX TO: A. BE TRAINED IN THE ADMINISTRATION OF THE HEIMLICH MANEUVER; AND B. THAT ONE SUCH PERSON TRAINED IN THE ADMINISTRATION OF THE HEIMLICH MANEUVER BE PRESENT IN THE SAME ROOM WHILE STUDENTS EAT MEALS, INCLUD- ING, BUT NOT LIMITED TO LUNCHROOMS, MULTIPURPOSE ROOMS, AUDITORIUMS AND OUTDOOR EATING FACILITIES. 2. THE COMMISSIONER SHALL BE AUTHORIZED TO PROMULGATE REGULATIONS FOR THE IMPLEMENTATION OF THIS SECTION. S 2. This act shall take effect immediately.
