AN ACT to amend the education law, in relation to creating  an  applica-
  tion  fee,  not  to exceed fifty dollars for the administration of the
  general education development program

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Section 317 of the education law, as added by chapter 170
of the laws of 1994, is amended to read as follows:
  S 317. General  education  development  exam.    [Notwithstanding  any
provision  of  law,  no  fee  shall be established for admission to] THE
COMMISSIONER SHALL ESTABLISH AND COLLECT  A  FEE  FROM  ALL  INDIVIDUALS
APPLYING  FOR  OR  SITTING  FOR  the general education development exam.
SUCH FEE SHALL NOT EXCEED FIFTY DOLLARS AND SHALL  BE  USED  EXCLUSIVELY
FOR  THE ADMINISTRATION AND SUPPORT OF THE GENERAL EDUCATION DEVELOPMENT
PROGRAM.
  S 2. This act shall take effect on the ninetieth day  after  it  shall
have become a law and shall only apply to exams administered on or after
such date.
