Amends the definition of "caregiver" for the purpose of obtaining the criminal history information of such person to include persons employed to provide 15 or more hours of care per week to senior, ill and disabled persons in the home of such senior, ill or disabled person.

BILL NUMBER:S3531 TITLE OF BILL: An act to amend the executive law, in relation to the definition of caregiver for the purpose of obtaining the criminal history information of such person PURPOSE: This bill would provide individual hiring in-home caregivers, including caregivers for seniors and persons having an illness or disability, with the opportunity to obtain the potential caregiver's criminal history background information (only upon the consent of the potential caregiver). SUMMARY OF PROVISIONS: This bill would amend the definition of "caregiver" in section 837-n of the Executive Law to include not only in-home caregivers for children, but also in-home caregivers for seniors and persons having illness or disability. OPPENHEIMER, KRUEGER -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the executive law, in relation to the definition of caregiver for the purpose of obtaining the criminal history informa- tion of such person THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 837-n of the executive law, as added by chapter 3 of the laws of 1998, is amended to read as follows: (a) "Caregiver" shall mean a person employed to provide fifteen or more hours of care per week to a child or children, SENIOR OR SENIORS, OR PERSON OR PERSONS HAVING AN ILLNESS OR DISABILITY in the home of such a child or children, SENIOR OR SENIORS, OR PERSON OR PERSONS HAVING AN ILLNESS OR DISABILITY. S 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
