BILL NUMBER:S3679 TITLE OF BILL: An act to amend the public health law, in relation to membership of the advisory council established within the acquired immune deficiency syndrome institute PURPOSE OR GENERAL IDEA OF BILL: Requires the selection of the advisory council be representative of people living with HIV/AIDS in the state of New York. SUMMARY OF SPECIFIC PROVISIONS: Section 1 is amended to reflect the following: Advisory council members shall be appointed to a four year term and can be re-appointed for another four years. Section 1 is further amended to reflect the following: The advisory council shall include 6 members living with HIV/AIDS. JUSTIFICATION: The advisory council must reflect the changing circumstances that encompass the HIV/AIDS community in the state of New York. SAMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to membership of the advisory council established within the acquired immune deficiency syndrome institute THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 2778 of the public health law, as amended by chapter 172 of the laws of 1990, is amended to read as follows: 1. There shall be established within the institute an advisory council composed of seventeen members who shall be appointed in the following manner: three shall be appointed by the temporary president of the senate and one by the minority leader of the senate; three shall be appointed by the speaker of the assembly and one by the minority leader of the assembly; nine shall be appointed by the governor. The governor shall designate the chairman of the advisory council. THE MEMBERS SHALL BE APPOINTED FOR A TERM OF FOUR YEARS, AND MAY BE RE-APPOINTED FOR ONE ADDITIONAL TERM OF FOUR YEARS. IN NO CASE SHALL ANY MEMBER SERVE MORE THAN A TOTAL OF EIGHT YEARS. VACANCIES SHALL BE FILLED IN THE MANNER OF ORIGINAL APPOINTMENTS FOR THE REMAINDER OF THE TERM. THE MEMBERS SHALL BE REPRESENTATIVE OF THE INFECTED POPULATION WITH HIV/AIDS IN THE STATE OF NEW YORK BASED ON CENTERS FOR DISEASE CONTROL (CDC) STATISTICS INCLUDING RACE, ETHNICITY, AND GENDER. THE COUNCIL SHALL INCLUDE AT LEAST SIX MEMBERS INFECTED WITH HIV/AIDS. The members of the council shall ALSO be representative of the public, educational and medical institutions, local health departments and nonprofit organizations, including organizations providing services to high risk populations.
