BILL NUMBER:S4218 TITLE OF BILL: An act to amend the election law, in relation to providing that public schools within New York state are not open for regular classes with their students on any primary election day PURPOSE OR GENERAL IDEA OF BILL: The purpose of the bill is to allow the New York City Board of Elections to conduct primary elections in New York City public schools without the presence of students enrolled therein. SUMMARY OF PROVISIONS: Section 1 of the bill amends Section 8-100 of the election law by adding a new subdivision 5. In a city having a population of one million or more, the public schools in such city shall not conduct any classes or other activities within its buildings which require the presence of students if such city is conducting a primary election pursuant to paragraph (a) or (b) of subdivision one of this section. Section 2 sets an immediate effective date.

AVELLA -- read twice and ordered printed, and when printed to be committed to the Committee on Elections AN ACT to amend the election law, in relation to providing that public schools within New York state are not open for regular classes with their students on any primary election day THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 8-100 of the election law is amended by adding a new subdivision 5 to read as follows: 5. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, ON ANY DAY ON WHICH A PRIMARY ELECTION IS CONDUCTED PURSUANT TO PARAGRAPH (A) OR (B) OF SUBDIVISION ONE OF THIS SECTION, IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE, THE PUBLIC SCHOOLS WITHIN SUCH CITY CONDUCTING A PRIMARY ELECTION SHALL NOT CONDUCT ANY CLASSES OR OTHER ACTIVITIES WITH- IN ITS BUILDINGS WHICH REQUIRE THE PRESENCE OF THE STUDENTS ENROLLED THEREIN.
