BILL NUMBER:S4364 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to recognizing out-of-state or national defensive driver classes PURPOSE: This legislation will allowing the commissioner to approve certain out of state and national defensive driving courses for the purpose of eligibility for the mandatory insurance reduction benefits. SUMMARY OF PROVISIONS: § 1: Section 399-b of the VAT law is amended by adding a new subdivision 7:7. "Out-of-state course" or "national course" shall mean an accident prevention course approved by acknowledged by any state other than New York State. §2: amends section §399-g to add language establishing the inclusion of certain out of state or national courses to the regulation section regarding which courses the commissioner may approve. §3: this act shall take effect immediately; provided, however, that section one of this act shall take effect on the ninetieth day after it shall have become a law.

LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to recognizing out-of-state or national defensive driver classes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 399-b of the vehicle and traffic law is amended by adding a new subdivision 7 to read as follows: 7. "OUT-OF-STATE COURSE" OR "NATIONAL COURSE" SHALL MEAN AN ACCIDENT PREVENTION COURSE APPROVED OR ACKNOWLEDGED BY ANY STATE OTHER THAN NEW YORK STATE. S 2. Section 399-g of the vehicle and traffic law, as added by chapter 290 of the laws of 1998, is amended to read as follows: S 399-g. Regulations. The commissioner shall promulgate such rules and regulations as are necessary to effectuate the provisions of this arti- cle, INCLUDING RULES AND REGULATIONS NECESSARY TO APPROVE CERTAIN OUT-OF-STATE OR NATIONAL COURSES. In addition to any requirements expressly authorized by this article, such regulations may include but not be limited to requirements and standards with respect to: delivery agencies and instructors; classroom facilities; suspension or revocation of approval; appeal of suspension or revocation; course administration and advertising; monitoring of courses and instructors; and reevaluation of course effectiveness pursuant to section three hundred ninety-nine-f of this article. S 3. This act shall take effect immediately; provided, however, that section one of this act shall take effect on the ninetieth day after it shall have become a law.
