BILL NUMBER:S4908 TITLE OF BILL: An act to amend the agriculture and markets law, in relation to providing assistance for community gardens PURPOSE OF BILL: This is a study bill, the purpose of which is to help support community gardens throughout New York State. This bill allocates a small portion of revenue generated by the sale, transfer or lease of such former community gardens and retains such funds for the continued support of local community gardens. The municipality may use the 20% of retained funds to purchase additional community garden lands, install capital improvements to other municipally owned community gardens, or to provide supplies and materials to support community garden activities. SUMMARY OF SPECIFIC PROVISIONS: Section 1: Adds Agriculture & Markets Law section 31-j which requires that municipalities create an account, the "community Gardens Account", to be funded with twenty percent of the proceeds from the sale, transfer or lease of property that was used as a community

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to provid- ing assistance for community gardens THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The agriculture and markets law is amended by adding a new section 31-j to read as follows: S 31-J. SALE OF COMMUNITY GARDENS PROPERTY. WHENEVER A MUNICIPALITY SELLS, TRANSFERS OR LEASES REAL PROPERTY WHICH WAS USED AS A COMMUNITY GARDEN AT ANY TIME WITHIN FIVE YEARS PRIOR TO SUCH SALE, TRANSFER OR LEASE, AND SUCH REAL PROPERTY BEING SOLD, TRANSFERRED OR LEASED WILL BE USED FOR A PURPOSE OTHER THAN COMMUNITY GARDEN PURPOSES, SUCH MUNICI- PALITY SHALL DEPOSIT TWENTY PERCENT OF THE PROCEEDS FROM SUCH SALE, TRANSFER OR LEASE INTO A SEPARATE ACCOUNT TO BE DESIGNATED THE "COMMUNI- TY GARDENS ACCOUNT". FUNDS FROM SUCH ACCOUNT SHALL BE USED EXCLUSIVELY FOR THE PURPOSES OF PURCHASING, ACQUIRING OR LEASING REAL PROPERTY TO BE USED AS COMMUNITY GARDENS, OR COSTS FOR IMPROVING COMMUNITY GARDEN PROP- ERTY. IN ADDITION, SUCH FUNDS MAY BE USED TO PROVIDE SUPPLIES AND MATE- RIALS NEEDED BY COMMUNITY GARDENS AND PROVIDING TECHNICAL AND FINANCIAL ASSISTANCE, IN CONSULTATION WITH THE OFFICE, TO NOT-FOR-PROFIT ORGANIZA- TIONS, NEIGHBORHOOD ASSOCIATIONS, SCHOOLS AND OTHER GROUPS THAT SPONSOR OR PROPOSE TO SPONSOR A COMMUNITY GARDEN. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law.
