AN ACT to amend the public health law, in relation to requiring the  use
  of thyroid collars for certain x-ray procedures

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 3516 of the public health law, as added by  chapter
175 of the laws of 2006, is amended to read as follows:
  S  3516. Use of x-rays with respect to dental services.  1. The use of
x-rays, performed in the course of dental  services,  shall  be  limited
solely  to  diagnostic purposes and shall not be used for the purpose of
verifying services performed for which requests for payment were submit-
ted to third party payors. Nothing in this section shall limit  the  use
of radiographic films or duplicates thereof.
  2.  X-RAYS  SHALL  NOT  BE  USED IN CONNECTION WITH THE PERFORMANCE OF
DENTAL SERVICES UNLESS THE PATIENT IS PROTECTED BY A THYROID  COLLAR  OR
OTHERWISE HAS THROAT PROTECTION AGAINST SUCH X-RAYS.
  S 2.  This act shall take effect immediately.
