BILL NUMBER:S6016 TITLE OF BILL: An act to authorize the commissioner of education to develop a plan for elimination in the use of trans fat in schools PURPOSE: To direct the commissioner of education to develop a plan for elimination in the use of trans fat in schools. SUMMARY OF PROVISIONS: Section 1. Authorizes the commissioner of education in consultation with the department of health to develop a public information program and protocol for eliminating the use of trans fat in prepared foods by any institution under the jurisdiction of the department of education including, but not limited to public schools. Section 2. Establishes the effective date. JUSTIFICATION: With childhood obesity on the rise, it has become increasingly clear that there is a need to help children develop healthier eating habits. One way to address this issue is by providing children with healthier food choices, by requiring schools to eliminate trans fat

DeFRANCISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to authorize the commissioner of education to develop a plan for elimination in the use of trans fat in schools THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Trans fat elimination program. 1. The commissioner of education, in consultation with the department of health, is hereby authorized and directed to develop a trans fat elimination program. For purposes of this act, "trans fat" means a specific type of fat formed when liquid fats are made into solid fats by the addition of hydrogen atoms, in a process known as hydrogenation. Such program shall consist of two main components: a public information campaign and a protocol for eliminating the use of trans fats in foods prepared by any institution under the jurisdiction of the department of education including, but not limited to, public schools. 2. The public information campaign shall be developed, in consultation with the department of health, to provide public service announcements, website sources and educational brochures about the health risks associ- ated with trans fat in foods. 3. The commissioner of education, in consultation with the commission- er of health, shall include in the department of education's annual report not later than December 31, 2013, a report assessing the success of the trans fat elimination program. Such report shall be submitted to the governor, the temporary president of the senate, the speaker of the assembly, and any appropriate committees of the legislature concerned with nutritional standards, education and health in New York state. S 2. This act shall take effect immediately. The commissioner of education is authorized and directed to promulgate any and all rules and regulations and take any other measures necessary to implement this act on its effective date on or before such date.
