BILL NUMBER:S7024 TITLE OF BILL: An act to amend the mental hygiene law, in relation to duties of providers of services for the developmentally disabled PURPOSE: To require all group for the developmentally disabled to post a visible notice to all employees that New York State law mandates the reporting of all forms of abuse to local law enforcement and district attorneys. Employees must also be trained with regard to these reporting requirements. SUMMARY OF PROVISIONS: Section 31.11 of the Mental Hygiene Law is amended by adding two new subdivisions 6 and 7. JUSTIFICATION: Many times employees of group homes for the developmentally disabled notice that a client has visible signs of abuse. However, they report it to their supervisor and this information never gets to law enforcement agencies where the perpetrator can be prosecuted. This legislation would require that the abuse be reported to law enforcement and district attorneys. It would also require that employees be trained in what action to take if they notice signs of

SALAND -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Develop- mental Disabilities AN ACT to amend the mental hygiene law, in relation to duties of provid- ers of services for the developmentally disabled THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 31.11 of the mental hygiene law is amended by adding two new subdivisions 6 and 7 to read as follows: 6. POSTING A VISIBLE NOTICE IN GROUP HOMES FOR THE DEVELOPMENTALLY DISABLED STATING THAT NEW YORK LAW MANDATES ALL MANDATORY REPORTERS OR EYEWITNESSES TO ABUSE OR NEGLECT TO REPORT ALL FORMS OF ABUSE TO LOCAL LAW ENFORCEMENT AND DISTRICT ATTORNEYS. THIS NOTICE SHALL INFORM THE EMPLOYEE OF THE NEED TO CALL 911 IN SUCH CASES. IT SHALL ALSO CONTAIN THE PHONE NUMBER OF THE LOCAL DISTRICT ATTORNEY. 7. ENSURING THAT ALL EMPLOYEES ARE PROPERLY TRAINED WITH REGARD TO THE REPORTING REQUIREMENTS FOR ALL FORMS OF ABUSE AND AS TO THE LOCATION OF THE POSTING REQUIRED IN SUBDIVISION SIX OF THIS SECTION.
