BILL NUMBER:S930 TITLE OF BILL: An act to amend the education law, in relation to including special education expenditures in the regents' annual report to the governor and the legislature PURPOSE: This legislation requires a statement setting forth the total expenditures made by each school district in the regents' annual report to the governor and the legislature. SUMMARY OF PROVISIONS: Section 215-a of the education law is amended by adding a new subdivision 3 to require a statement setting forth the total expenditures made by each school district in the regents annual report to the governor and the legislature. JUSTIFICATION: School districts continue to struggle with the costs associated with education special education students. Some districts have claimed that their special education costs exceed 20% of their total budget. Under current law, there is no requirement for the school districts to

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to including special education expenditures in the regents' annual report to the governor and the legislature THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 215-a of the education law is amended by adding a new subdivision 3 to read as follows: 3. THE ANNUAL REPORT REQUIRED PURSUANT TO SUBDIVISION ONE OF THIS SECTION SHALL INCLUDE A STATEMENT SETTING FORTH THE TOTAL EXPENDITURES MADE BY EACH SCHOOL DISTRICT FOR SPECIAL EDUCATION. SUCH STATEMENT SHALL INDICATE: (A) THE AMOUNT OF SUCH EXPENDITURES COVERED BY STATE AID; (B) THE AMOUNT OF SUCH EXPENDITURES COVERED BY FEDERAL AID; AND (C) THE AMOUNT OF SUCH EXPENDITURES NOT COVERED BY EITHER STATE OR FEDERAL AID. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD04400-01-1
