AN  ACT  to  amend the vehicle and traffic law, in relation to requiring
  that vehicles with purposefully obstructed license plates be impounded

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Subdivision  8  of section 402 of the vehicle and traffic
law, as amended by chapter 61 of the laws of 1989 and as  renumbered  by
chapter 648 of the laws of 2006, is amended to read as follows:
  8.  The violation of this section shall be punishable by a fine of not
less than twenty-five nor  more  than  two  hundred  dollars;  PROVIDED,
HOWEVER,  THAT  A  MOTOR  VEHICLE  WITH  PURPOSEFULLY OBSTRUCTED LICENSE
PLATES SHALL BE SUBJECT TO IMPOUNDMENT AND  ANY  PEACE  OFFICER,  ACTING
PURSUANT  TO  HIS SPECIAL DUTIES, OR ANY POLICE OFFICER IS AUTHORIZED TO
IMPOUND AND STORE SUCH MOTOR VEHICLE.
  S 2. This act shall take effect immediately.
