DenDEKKER -- read once and referred to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to an erro- neously issued parking violation summons THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 1200 of the vehicle and traffic law is amended by adding a new subdivision (e) to read as follows: (E) WHERE A COURT OR HEARING OFFICER DETERMINES THAT A PARKING VIOLATION SUMMONS WAS ERRONEOUSLY ISSUED DUE TO NO FAULT OF THE PERSON RECEIVING SUCH SUMMONS AND IS DISMISSED BECAUSE THE DRIVER DID NOT VIOLATE ANY LAW, THE COURT SHALL ISSUE A ONE HUNDRED DOLLAR PAYMENT TO THE PERSON WHO WAS ISSUED THE TICKET. S 2. This act shall take effect on the sixtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
