S T A T E O F N E W Y O R K ________________________________________________________________________ 8444 I N A S S E M B L Y January 15, 2014 ___________ Introduced by M. of A. BRINDISI -- read once and referred to the Commit- tee on Health AN ACT to amend the public health law, in relation to sudden, unexpected death in epilepsy THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 4141 of the public health law is amended by adding a new paragraph (e) to read as follows: (E) THE MEDICAL CERTIFICATE SHALL INCLUDE A DETERMINATION AS TO WHETH- ER THE DECEASED SUFFERED A SUDDEN, UNEXPECTED DEATH IN EPILEPSY, IN ACCORDANCE WITH STANDARDS ESTABLISHED BY THE COMMISSIONER. S 2. Section 4210 of the public health law is amended by adding a new subdivision 5 to read as follows: 5. EVERY AUTOPSY OF THE BODY OF A DECEASED HUMAN SHALL INCLUDE AN INVESTIGATION AND DETERMINATIONS AS TO WHETHER THE DECEASED SUFFERED A SUDDEN, UNEXPECTED DEATH IN EPILEPSY, IN ACCORDANCE WITH STANDARDS ESTABLISHED BY THE COMMISSIONER. IN THE EVENT THE DECEASED DID SUFFER A SUDDEN, UNEXPECTED DEATH IN EPILEPSY, SUCH INFORMATION SHALL BE REPORTED TO THE DEPARTMENT WITHIN THREE BUSINESS DAYS. S 3. This act shall take effect on the one hundred eightieth day after it shall have become a law; provided, however, that effective immediate- ly, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized and directed to be made and completed on or before such effective date.
